Terms and conditions of Account Users with Rental Solutions - Cape Cod

1. Layout and copy on RentalSolutions-CapeCod.com web site
* RentalSolutions-CapeCod.com reserves the right to determine the final design, layout and functionality of the RentalSolutions-CapeCod.com web site.
* RentalSolutions-CapeCod.com reserves the right to edit copy or amend the layouts or photographs supplied, should it be considered necessary.
* RentalSolutions-CapeCod.com reserves the right, at its discretion, to amend and edit copy entered into the RentalSolutions-CapeCod.com online database by Account Users.
* RentalSolutions-CapeCod.com cannot be held responsible for any loss or damage resulting from the design or positioning of the properties or changes made to the photographs and copy submitted by the customer.
2. Accuracy
* RentalSolutions-CapeCod.com cannot accept any legal responsibility for the accuracy of the advertisements and/or representations made by Account Users, or any alleged breaches of contract on an Account User's part and the Account User indemnifies RentalSolutions-CapeCod.com Limited against all costs, expenses and losses arising out of a claim relating to the content of an advertisement and/or representation..
* Account Users are responsible for keeping their availability accurate and up-to-date, particularly for periods where Searchable Special Offers are being displayed. Special offers are not displayed if the period they cover are marked as "booked" on the availability chart.
3. Photographic materials
* RentalSolutions-CapeCod.com will make every effort to safeguard all materials supplied, and return them if required, but cannot be held responsible for any loss or damage, however caused, and for any loss or damage sustained.

The Account User warrants that he is the owner of the copyright in such material or is authorised by the owner thereof to grant to RentalSolutions-CapeCod.com Limited the rights therein contained. RentalSolutions-CapeCod.com Limited cannot be held responsible for any infringement of copyright laws resulting from material supplied by the Account Users and the Account User indemnifies RentalSolutions-CapeCod.com Limited against any action brought for breach of copyright or other rights from the use of such material supplied by the Account User.
* RentalSolutions-CapeCod.com Limited cannot be held responsible for any infringement of copyright laws resulting from material supplied by the Account Users.
6. Hypertext links

7. Substitution of properties
* An advertisement relates to a specific property. The property in a listing may not be substituted by another property.
8. Advertising more than one property on one advertisement
* Each advertisement on the RentalSolutions-CapeCod.com site displays an individual property where people will spend their vacations - not examples of properties in a given area. Only one property can appear on each advertisement, unless it is a property with multiple rental units on the same site, and additional listing units are purchased. RentalSolutions-CapeCod.com reserves the right to amend the copy or remove the listing, when more than one property is described in the listing.
9. Termination of advertising
* If Account Users wish to have their listing removed from the Internet before the end of their subscription period, this will be done, but no refunds will be paid.
* RentalSolutions-CapeCod.com Limited reserves the right to refuse any listing for RentalSolutions-CapeCod.com web site, and will not be liable for any loss or expense in so doing.
* If an Account User attempts to enter unsuitable material into the RentalSolutions-CapeCod.com on-line database, or persistently misuses the on-line systems, RentalSolutions-CapeCod.com Limited reserves the right to remove the property from the RentalSolutions-CapeCod.com site. No refunds will be paid.
* If RentalSolutions-CapeCod.com receives a complaint from a person who has rented an Account User's property which RentalSolutions-CapeCod.com Limited, acting reasonably, consider is justified, or an Account User knowingly double-books a property, or engages in any unacceptable practices or is in breach of its obligations to RentalSolutions-CapeCod.com Limited, then RentalSolutions-CapeCod.com Limited reserves the right to remove the property from the RentalSolutions-CapeCod.com web site without notice.
10. Authorization to Export Data
* Account User acknowledges that in the sole discretion of RentalSolutions-CapeCod.com KISS Computing, Inc., it may be necessary to keep a copy of the Account User content and information outside of the Commonwealth of Massachusetts. If such a copy is made it will be used only in the day to day operations of RentalSolutions-CapeCod.com or its direct affiliates, and will not be shared with any third party
